Rules and Regulations of the Town of Weare Cemeteries

            For the mutual protection and benefit of lot owners, and each cemetery as a unit, the following rules and regulations have been adopted and all owners and visitors within the cemeteries, and all lots sold shall be subject to said rules and regulations, and subject further, to such amendments or alterations as shall be adopted by the Board of Trustees from time to time.

            Due to the explosive growth that has taken place in the Town of Weare over the past several years, it has become necessary for the Cemetery Trustees to adopt Rules and Regulations to ensure that the cemeteries maintain a dignified appearance and further to ensure that proper maintenance of the cemeteries does not become difficult or impossible as the sale of lots increases.

Definition of Terms

  1. The term "Trustees" or "Cemetery Trustees" shall mean the duly elected Cemetery Trustees of the Town of Weare.

  2. The terms "lot", "plot", and "burial space" shall be used interchangeable and shall apply with like effect to one or more adjoining graves.

  3. The term "interment" shall mean the permanent disposition of the remains of a deceased person by cremation and interment, entombment or burial.

  4. The term "memorial" shall include a monument, marker, tablet, headstone, private mausoleum or tomb for family or individual use.

  5. The term "Cremation Garden" shall mean that section of Pine Grove Cemetery set aside for burial only of cremated remains.

I.    Interments

  1. There will be no interments from December 1 to April 1 of each year. At other times interments will be at the discretion of the Trustees or its agent depending upon seasonal conditions.

  2. No interments shall be made without the prior notification of the Trustees, or its agent. All interments must be made at the direction of the Trustees and /or by the employee of the Trustees, or its agent. No one may individually inter human remains, including ashes, within the confines of the cemetery without the express, written consent of the Trustees or its agent. No interments shall be made of other than human remains: i.e. no family pets.

  3. No interments shall be made until such time as the lot has been paid for in full.

  4. All caskets or coffins must be enclosed in a sealed vault at the time of interment. The only vaults permitted are one-piece or six-piece vaults or grave liners are acceptable.

  5. After an interment, mourners may leave flowers on gravesite for three days, after which they will be removed.

II.    Transfer or Assignment of Lots

  1. Only residents or individuals who can prove past residence are permitted to purchase cemetery lots from the Town of Weare. A maximum of one six-person lot can be sold to any individual or family. Corner markers required for all lots.

  2. No lot may be transferred or assigned to another individual by the lot owner. Any owner wishing to sell his/her lot or a portion of a lot, must sell said lot to the Town of Weare for the original purchase price. The Town of Weare may then transfer the lot to another individual.

1 person lot $150.00 plus the cost of corner markers.
2 person lot $300.00 plus the cost of corner markers
4 person lot $600.00 plus the cost of corner markers.
6 person lot $900.00 plus the cost of corner markers.

III.    Work Within The Cemeteries And Decoration Of Lots

  1. All improvements or alterations of individual lots within the cemetery shall be under the direction of and subject to the consent, satisfaction, and approval of the Cemetery Trustees or its agent. If any trees or shrubs, situated on any lot shall, by means of their roots or branches, become detrimental to the adjacent lots or avenues, or unsightly or inconvenient for maintenance, the Trustees shall have the right to remove said trees or shrubs or such parts thereof as they shall determine to be detrimental.

  2. The Trustees shall have the authority to remove all floral design, flowers, weeds, plants or herbage of any kind from the cemetery as soon as, in the judgment of the Trustees, they become unsightly, dangerous, detrimental, or diseased. The Trustees shall not be responsible for floral pieces, baskets, or frames to which said floral pieces are attached, nor for any flower vases or urns. No shrubs shall be placed on any lot without a monument.

  3. No curbing, fencing, hedging, grave mound borders, or enclosures of any kind shall be allowed around any lot; and no walks of brick, cinders, tile, stone, marble, sand, cement, gravel, or wood shall be allowed on any lot.

  4. No bark mulch, or other similar material, shall be spread over the lot in place of grass or other ground cover such as moss.

  5. All artificial flowers will be removed by October 15. Artificial flowers must be contained in an appropriate container.

  6. Planting of flowers is restricted to one foot around the four sides of the head stone.

IV.    Monuments And Markers

  1. Only one central or family memorial shall be allowed on a lot and that shall be set on the space designated by the Trustees or its agent. Any individual markers must be flush with the ground and the lettering must be incised not raised.

  2. No lot owner shall erect or place, or cause to be erected or placed, on any lot in the cemetery any memorial without the prior approval of the Trustees or its agent.

  3. All memorials shall be placed in a line which is even with all other monuments in that row, thereby forming a straight line.

V.    Cremation Garden

  1. Only flush head stone will be allowed in the Cremation Garden. Flush markers with retractable vases may be used only if the vases are returned to the flush position when the flowers are removed.

  2. There shall be only two flush head stones per 2 person lot. Each head stone shall be no larger that 12" by 24".

  3. Corner markers will be the same numbered iron pins.

    2 person lot (2' by 2') will be $150.00 including the corner  markers.

VI.    Hours Of Availability

            The cemetery grounds shall be open from 8:00 a.m. to 8:00 p.m. Any entry onto said cemetery grounds at other times, without the prior consent of the Trustees or its agent, shall constitute trespass. The cemetery may be closed to the general public if any conditions within the cemetery grounds become hazardous, including ice and snow. The cemetery will not be used for any recreation purposes.
